Attack on Press Freedom and Criminal Intimidation at DPS CGHS

I am a national award winning journalist. As I have been facing repeated threats from the MC members of DPS Housing Society, I had sent the following email to Delhi Police, Lt. Governor’s (LG) office, and the Ministry of Information & Broadcasting (I&B), Govt. of India.

Although Delhi Police informed me on May 28, 2018 that the case has been sent to Dwarka police station, no action has yet been taken against the accused MC members of DPS Housing Society. My email is given below.

Dear Sir,

I am a government’s national award-winning journalist and social activist. Earlier, I have worked with the United Nations (UN) through United Nations Industrial Development Organization (UNIDO) as a digital media expert.

Now, along with my other social and media services, I have been running a free community-driven online editorial service under the banner “Clean House” in order to help the suffering residents raise their voice against the growing corruption and injustice particularly in the housing societies of Delhi.

It works as an interface to inform the government departments and law-enforcement agencies in India and abroad about the cases of corruption and other illegal activities happening in Delhi’s cooperative group housing societies.

Since many corrupt managing committee (MC) members of housing societies and government officials are facing government inquiries because of my comprehensive complaints against them, they have been trying to intimidate and harm me.

Current Case

In this regard, I want to inform you about a false complaint that the MC members (through president Neeraj Kumar Vaish) of DPS Cooperative Group Housing Society (DPS CGHS), Sector 4, Plot No. 16, Dwarka, New Delhi 110078 have filed against me and my global news service (Raman Media Network) about an email message circulation.

The message conveyed about a recent Delhi High Court judgment that stopped harmful and unauthorized FAR construction (that harms men, women, and children with dust and noise pollution) in a group housing society of Dwarka.

People in Delhi frequently circulate my articles because they are very useful and informative. But the accused MC members at DPS CGHS where I live felt offended because they themselves have been planning this illegal FAR construction while they are already facing multiple corruption inquiries ordered by the Delhi Government as well as the Central Vigilance Commission (CVC) where I had complained about the DPS CGHS corruption and other illegal activities.

In order to settle a score with me, the accused MC members of DPS CGHS have filed a false complaint against me with the SHO, Dwarka North Police Station on 22.05.2018 about the email circulation of the news article. Their complaint (reproduced below) is full of lies and distorted facts filed with a malafide intention to harm me and my professional editorial work.

You are requested to fully investigate this case to find out the reasons for filing this false complaint against me. And please investigate on what basis the accused MC members of DPS CGHS reached the conclusion that I shared the email ids with the person who circulated the article link.

The complaint has been filed against me on false presumption and as a vindictive act. And even if this article link about a public information is circulated among DPS CGHS members, which law does it break? The name of another person is mentioned in the complaint. As I do not know that person, in all probability the accused MC members have deceptively roped him in to make a false case against me.

Multiple Threats

This is also to inform you that in order to thwart my anti-corruption efforts, the accused MC members of DPS CGHS have sent multiple threats to me during the past couple of years. These include false police complaints, threats of physical harm to me, expulsion notices, legal notices, and slanderous attacks on my social as well as professional status.

As I am a victim of the fraud and intimidation happening at DPS CGHS, I am facing repeated threats from the accused MC members and their supporters because I have been raising my voice against their corruption, lawlessness, environmental damage, and human rights violations.

In the current case, the accused DPS CGHS MC members – who have tried to harm me repeatedly in the past – have publicly pasted the letter dated 22.05.2018 written to the SHO on the notice board of the Society with the aim to defame me among the Society residents. This is an extreme slanderous attack on me as well as my journalistic profession.

This is also an attack on my editorial freedom and my freedom of expression and speech guaranteed to me by the Constitution of India through Article 19. The accused MC members of DPS CGHS have no authority to attack my fundamental right to inform others through my news articles.

As I am extremely terrified by the threats from the accused DPS CGHS MC members who can even physically assault me, you are requested to depute a senior police officer to investigate the case and inform me about your findings immediately. Please question the following MC members of DPS CGHS in this case:

  1. President: Neeraj Kumar Vaish
  2. Vice President: R. Balasubramanian
  3. Secretary: M.N. Sampathkumar
  4. Member: Ms. Leela Swami
  5. Member: Sandeep Taneja
  6. Member: Manguram Tyagi
  7. Member: Ms. Naseem Afshaque

Note: As I had filed a complaint in the National Human Rights Commission (NHRC) against these MC members, Delhi Police under the directions from NHRC had questioned the MC members of DPS CGHS last year for their illegal activities and human rights violations.

But the MC members had deceived the police by saying that they are elected members and only RCS office can question them. Surprisingly, the Delhi Police had accepted this weird argument and did not take any action against the MC members of DPS CGHS. While election is a total fraud at DPS CGHS, even elected members and lawmakers are not supposed to break the law. Delhi Police must keep these facts in view while investigating the current case.

In the current case of email circulation of an editorial article link, I categorically urge Delhi Police to thoroughly investigate the case and file specific charges against the MC members of DPS CGHS for false police complaint against me, attack on my freedom of expression, attack on press freedom, criminal intimidation, and defamation.

I request Delhi Police to inform me about the progress of their investigation in the next couple of days – by May 30, 2018.
