Notice Issued to Stop FAR Construction at Seema CGHS Dwarka

As FAR construction is spreading lethal dust and noise pollution in Delhi, you should join the campaign against FAR construction by supporting the Green Group of Delhi that I run for environment protection in Delhi.

It is a known fact now that the FAR (floor area ratio) construction in occupied cooperative group housing societies (CGHS) of Delhi is a serious crime.

As corruption worth thousands of crores of rupees is happening in FAR construction, the corrupt management committee (MC) members of housing societies are carrying out FAR projects in connivance with the dishonest officials of Delhi Development Authority (DDA), the office of Registrar Cooperative Societies (RCS), Delhi Fire Service (DFS), and Delhi Urban Art Commission (DUAC).

Now, the MC of Seema CGHS in Dwarka has embarked upon the potential FAR misadventure. The following “Show Cause Notice” has been issued to the President / Secretary of Seema CGHS Ltd. – who did not respond. So, the case will proceed.

Subject: Show Cause Notice for Illegal FAR (floor area ratio) construction and other irregularities at Seema CGHS

Dear President / Secretary,

I am a government’s national award winning journalist and social activist. I also run many environment-protection campaigns and an anti-corruption social service “Clean House” to help the suffering residents of Delhi raise their voice against the growing corruption and injustice in cooperative group housing societies (CGHS).

Recently, some residents of your Society (Seema CGHS) approached me so I could help them stop FAR construction among other irregularities in your Society. In this regard, before I proceed with this case, I want to give you an opportunity to respond to the following queries, letting me know why administrative and legal action should not be taken against the management committee (MC) members of your Society (Seema CGHS).

1. While the office of the Registrar Cooperative Societies (RCS) has issued specific directions and it is mandatory to make a Society website to keep all the members informed of your activities in a transparent manner, why have you not made a website for Seema CGHS?

2. Can you create Seema CGHS website by April 10, 2019 and upload all the information / communications on the website including the financial information of your Society along with supporting vouchers / documents for the past 3 financial years, beginning 2016-17?

3. While the FAR construction in occupied group housing societies is an illegal activity because it violates many extant laws, why are you insisting on FAR construction at Seema CGHS?

4. Why are you misusing your authority by planning FAR construction privately just for one block of the Society while the Society is a complete unit comprising all the flats and members?

5. Why do you want to deprive the citizens (including men, women, children, and even senior citizens) of their fundamental right to live in a clean, pollution-free environment while FAR construction in the Society will spread lethal dust / noise pollution as well as other disturbance?

6. Why do you want to mislead the residents / members by saying majority rule will apply while the fundamental rights in India are for every citizen and if even one citizen’s rights are abused it will be construed as a crime?

7. What is your motive behind starting illegal FAR construction as you have been arrogantly ignoring the requests of members who oppose FAR construction and which is causing extreme agony and mental disturbance to these members?

8. Why should it be believed that you will not bribe the government officials to take FAR and related approvals when you are already working in an opaque manner?

9. Will you stop pursuing FAR project immediately and inform all the members that you will not carry out FAR construction at Seema CGHS?

10. You can add any other point from your side to put forward your point of view.

Please send me your response positively by March 29, 2019. If I did not receive your response by March 29, 2019, it will be assumed that you have nothing to say in this matter and I will proceed to take this case forward with the information that I have.
