Case Update: Corruption at DPS CGHS

The DPS CGHS managing committee (MC) members [President: Neeraj Kumar Vaish, Vice President: R. Balasubramanian, Secretary: M.N. Sampathkumar, Member: Ms. Leela Swami, Member: Sandeep Taneja, Member: Manguram Tyagi, Member: Ms. Naseem Afshaque] who are facing multiple government inquiries for financial frauds and other crimes have started an illegal construction / repairs project in the Society building under the dubious floor area ratio (FAR) scheme.

The accused DPS CGHS MC members – who have been trying to stop the corruption inquiries against them presumably by bribing the government officials at the Registrar Cooperative Societies Court (RCS Court) or using other unscrupulous tricks – had a major setback on Tuesday, July 30, 2019. The Court of the Financial Commissioner (FC Court) has asked the RCS office to explain why it is delaying the inquiry into “financial and other irregularities” at DPS CGHS. The FC Court is a higher court to the RCS Court.

Similarly, in another court hearing at RCS Court on July 30, it was observed that the inquiry into the “financial and other irregularities” at DPS CGHS ordered by the RCS Court under Section 61 of the DCS Act is required, as there have been serious instances of misappropriation of public funds and other irregularities committed by the accused DPS CGHS MC members. 

All the arguments – including the excuse of majority decisions in General Body Meetings (GBMs) – given by the DPS CGHS MC have been rejected. The law says that for serious offences even one member of the society can get the MC removed from office. The RCS Court stated this fact in its hearing on July 30.

The inspection ordered by the RCS Court under Section 61 is a prelude to the proceedings under Section 37 of the DCS Act, 2003 for the supersession (termination or dismissal) of the DPS CGHS MC under serious corruption charges.

The DPS CGHS MC has stated that the petitioners Mr. Davinder Wazir (Flat No. 123), Ms. Anita Bhagat (Flat No. 401), Mr. K.V. Varghese (Flat No. 313), and Mr. H.K. Kaul (Flat No. 121) have withdrawn from the RCS Court case. 

If that is true, there are sufficient grounds to believe that these four petitioners have withdrawn either under threats from the MC or they have been bribed to derail the corruption inquiries against the MC members. Therefore, they are part of the DPS CGHS corruption racket which is being investigated. They will appear in future legal documents as hostile petitioners who will have to explain their change of position in the court.

If these four petitioners have not withdrawn from the RCS Court case, they should formally accuse the MC members for telling lies about them and circulate their exact decision through email among all the members. They should also ask the MC to put their actual decision on the DPS CGHS website. Otherwise, these four hostile petitioners will appear as accomplices of the accused DPS CGHS MC members.

Their withdrawal from the case will not have any effect on the proceedings at the RCS Court because even a single petitioner can pursue the case. And now there are sufficient proofs that the anti-corruption and law-enforcement agencies have on the basis of which the inquiries have been ordered against the DPS CGHS MC.

The FAR construction / repairs being carried out by the accused DPS CGHS MC members in the Society building will be part of the government investigations because there are serious lapses in appointing the vendors, architects, and construction companies for this project worth crores of rupees. Again, even a single member in the society can raise objections against the fraudulent acts of the MC and GBM majority decisions in such financial matters are not valid.

The accused DPS CGHS MC members are deliberately misinterpreting a couple of court judgements about majority decisions just to hoodwink the members and loot their money for the construction / repairs work. If you read those judgements carefully, you will come to know that majority of the members in a housing society cannot take such decisions and impose them on other members.

Case Update: FAR Crime at DPS CGHS

Started on July 1, 2019, the illegal FAR construction / repairs project is being carried out by the accused DPS CGHS MC members in connivance with the corrupt government officials at Delhi Development Authority (DDA), Registrar Cooperative Societies (RCS), Delhi Fire Service (DFS), and Delhi Urban Art Commission (DUAC). 

With lethal dust and noise pollution and the possibility of accidents, the FAR construction is extremely harmful to hundreds of people – including men, women, children, and senior citizens – who are living in the Society building. The residents have been complaining about this harmful construction, but the DPS CGHS MC members have ignored the residents’ complaints.

Rather, the DPS CGHS MC members are forcing the residents / members to pay them lakhs of rupees, while the accused MC members are already facing inquiries ordered by the RCS Court for financial and other irregularities.

The accused DPS CGHS MC members have been obstructing the financial inspection and threatening the Society residents / members to pay them huge money for construction / repairs for the construction project which is estimated to be of Rs. 15 crore. They have fraudulently clubbed construction with repairs to extort money from the members. 

While each member has been paying thousands of rupees each month to the MC for maintenance and repairs, instead of using that money for repairs, the DPS CGHS MC members are forcing every member to pay lakhs of rupees more for the repairs. So, people who are paying for the so-called repairs are, in fact, paying for FAR construction. Obviously, it is a big fraud being committed by the MC. 

As the DPS CGHS MC members say they have given lakhs of rupees to construction companies and government departments for starting FAR construction, they had no other option but to willy-nilly start unlawful construction. Now they are showing some superficial construction in the building to demand money from members while it is an illegal activity.  

The accused DPS CGHS MC members – who are operating as mobsters – are also threatening the members / residents who complain against their illegal activities with false legal notice, police complaints, and expulsion notices. 

While the accused DPS CGHS MC members are misusing the Society website to mislead the members with selective information, they do not put on the website the response / communications from the members about their reckless actions. They also do not put on the website about the proceedings and decisions of the cases that they are facing at different courts.

Also, the following external firms have been hired by the accused DPS CGHS MC members without following the proper tendering / purchase processes. The accused DPS CGHS MC members are giving only incomplete information through the Society website and emails about their deals with these firms. These surreptitious deals will be part of the investigations at DPS CGHS. The firms are:

While the accused DPS CGHS MC members say that majority of the members have allowed them to carry out this construction / repairs in the building, the truth is that with lethal dust and noise pollution and the possibility of accidents, the FAR construction is breaking many existing laws including the Article 21 of the Indian Constitution, Unified Building Bye Laws (UBBL), Delhi Apartment Ownership Act, Delhi Fire Service (DFS) Rules, National Building Code (NBC), Easementary Rights, Delhi Preservation of Trees Act, Delhi Cooperative Societies Rules, 2007, and Maintenance and Welfare of Parents and Senior Citizens Act.

As explained above, the majority of members in a housing society are not allowed to commit unlawful activities. Even when a single citizen’s rights to live in a clean, pollution-free environment are abused, the police and law-enforcement agencies must intervene and stop that illegal activity. Now with haphazard construction activity, the DPS CGHS building has become a virtual hell in which it is almost impossible to live.

While many members / residents are opposing the illegal FAR construction and repairs work in the Society building, the accused DPS CGHS MC members are hell-bent to disturb the residents with this harmful construction which – if allowed – will run for years and give another opportunity to the MC members to swindle public money worth crores of rupees. 

Now many members – who oppose FAR construction / repairs at DPS CGHS – are ready to go to the court for getting the construction activity stopped. While it is a totally illegal activity and the DPS CGHS MC is facing serious corruption and supersession cases, the FAR construction / repairs activity will get stopped. 

But the opposing members will file their petitions to stop FAR construction / repairs only when the flats are totally damaged by the DPS CGHS MC. At that stage, the MC will be heavily penalized and the members who have paid money for FAR construction / repairs will lose their money, and they will not be able to live in broken flats.

The wise members should not pay any money to DPS CGHS MC for FAR construction / repairs and those who have already paid should demand their money back from the MC instead of becoming part of the construction crime.

Now, the DPS CGHS MC members have formed a fully functional gang with the help of about 30 more Society members who support all sorts of criminal activities – including FAR construction / repairs – of the MC members. 

While they are also threatening other members to join their gang, their very existence in the Society is a threat to the peace and cooperative culture that is supposed to prevail in a housing society. Note: I have written this report not only as a journalist, but also as a victim of the fraud and intimidation happening at DPS CGHS. I am facing repeated threats from the MC members and their supporters because I have been raising my voice against their corruption, lawlessness, environmental damage, and human rights violations. These threats include false police complaints against me, threats of physical harm to me, expulsion notices, legal notices, arbitrary financial penalties on me, and slanderous attacks on my social as well as professional status.
