Legal Notices Issued to Know EVM Frauds in Indian Elections

If it is proved in the court that Modi and BJP had manipulated the EVMs to win the election deceptively, then Modi can be prosecuted, impeached, and imprisoned.

It is largely believed that the Prime Minister Narendra Modi’s party BJP committed large-scale tampering of electronic voting machines (EVMs) to win the recent Lok Sabha election in India.

The field reports suggest that without EVM manipulations, BJP would not have won even 100 Lok Sabha seats. But with EVM fraud, Modi’s party managed to win 303 of the 543 Lok Sabha seats.

The opposition parties were vociferously opposing the use of EVMs before the election with allegations that BJP colludes with the Election Commission of India (ECI) to tamper with the voting machines to win elections. But when the election results were declared in May 2019 and BJP won, all opposition parties went into a state of stony silence and did not challenge the results.

The opposition groups are led by spineless leaders who have stopped raising their voice on all crucial issues such as corruption in the Rafale deal, joblessness, farmers’ distress, and so on.

However, the EVM fraud issue has come to life once again. Of late, a Pune-based political activist Maruti Bhapkar has issued legal notices to the Arizona-based Microchip Technology Inc. and Renesas Electronics headquartered in Tokyo on the alleged EVM manipulation in the recent election.

It is said that the chip used in the EVMs was not of OTP (One Time Programmable) category. That means, it can be programmed in each EVM to change the vote count in favor of a particular candidate.

As ECI did not disclose this information before the election, BJP allegedly took advantage of the situation and won the election by programming the chips surreptitiously in connivance with the ECI.

According to a report in The Hindu newspaper, the notices – issued through noted lawyer-activist Asim Sarode – has asked the tech firms to publicly disclose copies of their agreements or contracts made with the ECI.

It is learnt that four foreign companies were employed for microchip production for EVMs that were used in Indian elections, but so far the legal notices have been issued to only two of them. A legal notice has also been sent to the Chief Election Commissioner for alleged breach of constitutional mandate provided in Article 324 of the Constitution of India.

While Article 324 mandates the ECI to conduct elections under its superintendence, directions, and control, it violated the law by outsourcing the election work to external private companies.

It is argued that since the ECI had decided to investigate the mismatch between Voter Verifiable Paper Audit Trail (VVPAT) slips and the EVM count, the vulnerability of EVMs cannot be ruled out.

If it is proved in the court that Modi and BJP had manipulated the EVMs to win the election deceptively, then Modi can be prosecuted, impeached, and imprisoned.

In a similar case of alleged election fraud, the U.S. President Donald Trump is currently facing impeachment inquiry initiated by the U.S. Congress. It is alleged that Trump had won the 2016 presidential race deceitfully by colluding with the enemy nation Russia.
