The law-enforcement authority RCS has issued a notice to the S-Gang (or DPS CGHS MC members) asking the gang members to explain why they broke the gas pipelines and criminally stopped gas supply to the flats.

The S-Gang, which is perhaps the most notorious criminal gang in India’s capital New Delhi, is spreading its wicked wings in all directions of criminality.

Formed by M.N. Sampathkumar – who claims to be a former employee of Air India – Sampathkumar gang (or S-Gang) has now unleashed extreme horror in the streets of Delhi.

In order to frighten the residents with its terror activities, recently S-Gang broke the IGL (Indraprastha Gas Limited) gas pipelines multiple times at DPS CGHS of Dwarka, which is the current headquarters of the gang, as it operates under the guise of the managing committee (MC) of DPS housing society.

With its current focus on property grabbing, S-Gang – which operates on the lines of D-Company – broke the gas pipelines to scare the residents so that they should run away and S-Gang members could usurp their flats.

It is being observed that the S-Gang leaders – including Sampathkumar (Flat No. 151), Neeraj Kumar Vaish (Flat No. 153), R. Balasubramanian (Flat No. 322), Leela Swami (Flat No. 173), Sandeep Taneja (Flat No. 473), Manguram Tyagi (Flat No. 133), and Naseem Afshaque (Flat No. 172) – have also colluded with builders’ mafia to seize people’s houses by forcibly driving them out. 

The S-Gang leaders supported by a slew of other local gang members from DPS CGHS are attempting the land grabbing crimes under the garb of an illegal construction project which is so harmful that the residents are leaving their flats in panic. 

NOTICE FROM RCS FOR CONSTRUCTION CRIME

As most members are scared of the criminal activities and violent behavior of the Sampathkumar gang, they prefer to run away instead of complaining against the gang. People who complain against the S-Gang face extreme threats and torture by the gang.

As a journalist and social activist, I have been complaining against the crimes and corruption of S-Gang, which has been issuing regular threats to me – including threats of physical harm to me, expulsion notices, legal notices, arbitrary financial penalties on me, and slanderous attacks on my social as well as professional status.  

Since I am determined to get the S-Gang members and their accomplices arrested and imprisoned, I reported the gang’s crime of breaking the gas pipelines to the police and other authorities including the Registrar Cooperative Societies (RCS) of Delhi Government.

With its letter dated 30.08.2019, the RCS office issued a notice to the S-Gang (or DPS CGHS MC members) asking the gang members to explain why they broke the gas pipelines and criminally stopped gas supply to the flats.

Since the S-Gang wants to drive out the residents from their flats so that it could occupy those flats illegally, it did not inform them about my representations and the RCS notice that questioned the gang’s criminality. 

There are many other investigations being conducted against the S-Gang’s criminality in floor area ratio (FAR) construction and shady repairs. But the accused S-Gang members do not inform about them to the residents because if residents came to know about the illegality of construction-repairs, they will stop paying them the money and oppose their criminal acts which are increasing at a rapid pace.

The S-Gang members are misusing the society website only to threaten members with frivolous expulsion notices, etc. but they are deliberately concealing the government notices that are questioning their criminality, and not putting them on the website. 

POLICE COMPLAINT AGAINST S-GANG

As the RCS notice also mentions about the FIR (police complaint) against the gang members, the Delhi Police has informed me that it is investigating the matter in which Delhi Development Authority (DDA) is also being questioned.

Now the gang members – whose names appear in government and police files as serial offenders – may bribe the RCS officials and police to get the notice revoked. While I am closely observing all their crimes, and the law-enforcement agencies are constantly informing me about their actions against Sampathkumar gang, soon the gang members and their partners in crime are expected to be behind bars.

As the justice delivery system is extremely slow in India, there are chances that some of the gang members will die before they are convicted and jailed. Therefore, I am making the cases in such a way that in the event of their deaths, their children or other legal heirs will have to face the legal consequences including the punishment and penalties.

In the case of damaging the gas pipelines at DPS CGHS, I have also complained against the IGL officials who are complicit in crime and probably bribed by the S-Gang to continue the illegal construction. 

The collusion of IGL officials in this crime is evident from the fact that they did not reply to an RTI application filed on 29.07.2019 to know why IGL has allowed the DPS CGHS MC (or the S-Gang) to continue illegal construction that can cause serious accidents or fire mishaps in the building where hundreds of people are living.

CRIME STRATEGY PLANNING GROUP OF S-GANG

Along with the S-Gang members and IGL officials, local DPS CGHS members who have been conspiring with the gang as a dubious “Strategy Planning Group (SPG)” for starting illegal and harmful construction are also being named in the police complaints and legal cases. 

All these so-called SPG members are aware of the construction criminality including the damage of gas pipelines, but they are still supporting the illegal construction. Obviously, they are part of the crimes being committed by the S-Gang, which is operating as DPS CGHS MC.

According to the MC documents, the additional members in its SPG are: Dilip Rozekar (Flat No. 111), M.M.Shukla (Flat No. 112), C.B. Swami (Flat No. 173), Pranav Kulshreshtha (Flat No. 163), Ravinder Sharma (Flat No. 113), O.P. Khanduja (Flat No. 261), Manish Bisht (Flat No. 253), Kaushik Banerjee (Flat No. 273), Narender Kumar (Flat No. 233), L.S. Thakur (Flat No. 301), Gaurav Sood (Flat No. 223), Sunil Bansal (Flat No. 311), Dr. Alok Varshney (Flat No. 323), Vineet Dua (Flat No. 412), Kashmera Randhawa (Flat No. 431), and Vikas Sharma (Flat No. 451).

As the S-Gang is constantly threatening the residents, it claims that four members have withdrawn their complaints / legal cases that they had filed against the gang, and now these four members are supporting the criminal activities of the gang. They include Davinder Wazir (Flat No. 123), Anita Bhagat (Flat No. 401), K.V. Varghese (Flat No. 313), and H.L. Kaul (Flat No. 121). Presumably, these members have been either bribed or threatened by the MC to join the gang. As they have become hostile petitioners, they will have to explain the change of their positions in the court.

It is also learnt that two of these four members – who have decided to support the crimes of the S-Gang – have assets disproportionate to their known sources of income and have built properties in other Indian states. And one member from Jammu & Kashmir (J&K) region has been accused by the Sampathkumar gang of anti-national activities. This case is already in the police records.

Obviously, all these cases of disproportionate assets and anti-national activities of the new partners of the S-Gang are being reported to the police and law-enforcement agencies for further investigations.

Also, the following external firms have been hired by the accused S-Gang members (DPS CGHS MC members) without following the proper tendering / purchase processes.

The S-Gang of Sampathkumar has also violated the terms of agreements with these firms. The S-Gang members also told lies about the firms’ record, because some of them are already facing legal cases for illegal construction. 

The S-Gang members knew about the legal cases against the firm(s), but still preferred to hire them for the fraudulent FAR construction / repairs project. The corruption money involved in this illegal project is estimated to be crores of rupees. 

These firms should have stopped working on the illegal project, but they have continued even when they know that the ongoing construction is violating the conditions specified in the DDA sanction letter for DPS CGHS.

COURT CASE AGAINST ILLEGAL CONSTRUCTION

Meanwhile, the residents who have been opposing the illegal activities of the S-Gang are ready to file a legal case against the gang’s crimes – including illegal construction at DPS CGHS – at a higher court. However, they are waiting for the misguided members who support the S-Gang to pay more instalments of lakhs of rupees for FAR construction or fraudulent repairs.

The legal case to stop illegal construction at DPS CGHS will be filed when the S-Gang has blocked crores of rupees of public money in the construction and the building is totally damaged. 

At that time, the construction companies and the people who are paying money for construction or repairs will lose their money and the S-Gang will be punished with heavy penalties including the forfeiture of their assets such as flats. 

It is learnt that some of the S-Gang members have multiple benami properties within DPS CGHS, in Dwarka, in Delhi, or other parts of the country. All these benami (property owned under the name of a proxy to conceal the identity of the actual buyer) assets are part of the ongoing investigations.

Wise people can easily understand from the incidents of gas pipeline breakage and multiple other construction violations by the S-Gang that it is an illegal construction project which will easily be stopped by the court as soon as the residents decide to file the case. In a similar case [W.P.(C) 286/2018], the Delhi High Court has stopped FAR construction at R.D. Apartments of Dwarka.

Therefore, it is learnt that some DPS CGHS members who have already paid a few lakh rupees for FAR construction / repairs are demanding their money back from the DPS CGHS MC and there are others who are not willing to pay more for illegal construction / repairs at DPS CGHS. 

Since the DPS CGHS building has already become a disputed property under illegal construction and various government investigations, it is learnt that people are not able to sell their flats even at half the rate of the actual market value. Tenants are also not willing to live in the ruined DPS CGHS building.

Now, most members understand that it is an illegal construction work that the S-Gang has started while the S-Gang or DPS CGHS MC is already under multiple corruption inquiries started by the government. It is expected that soon the construction companies or builders will also stop working at DPS CGHS instead of losing their money in the legal disputes.

The FAR construction under the garb of repairs is also illegal because S-Gang is not supposed to do it as it is under massive corruption investigations ordered by the government. Currently, the S-Gang members (or DPS CGHS MC members) are facing a financial inspection ordered by the RCS Court under Section 61 of the DCS Act, 2003 for corruption of an estimated amount of Rs. 20 crore

The accused gang members are also facing a case under Section 37 of the DCS Act, 2003 for their supersession (termination) under charges of large-scale corruption, impropriety, abuse of power, and other irregularities. 

Now, along with the RCS Court, the corruption case against DPS CGHS MC members (who operate as S-Gang) has also reached the Court of the Financial Commissioner (FC Court) which is a higher court to the RCS Court and primarily deals with serious financial crimes. The last hearing at FC Court on September 5, 2019 could not take place because of the non-availability of the court judge.

In response to my complaints, another hearing is scheduled for September 14, 2019 at Delhi Secretariat about the corruption case of DPS CGHS in which the S-Gang members (or DPS CGHS MC members) and others are involved.

As I have submitted conclusive evidence against the S-Gang members to the anti-corruption agencies, soon the charge sheet is expected to be filed against them to proceed with the trial and subsequent prosecution. 

There may be judicial delays, but the Sword of Damocles will keep hanging over their heads, as I am working hard to get all S-Gang members (or DPS CGHS MC members) and their accomplices arrested and imprisoned.
